Terms of Service
These Terms govern your use of Filepeek. Please read them carefully: by using Filepeek, you agree to them.
- Free to use, no account required
- Your files stay on your device
- Use only files you have the right to
- Provided as is, without warranties
1. Acceptance of these Terms
These Terms of Service (the "Terms") are a binding agreement between you and Fileport Inc., a Delaware corporation ("Fileport", "we", "us" or "our"), which owns and operates Filepeek at filepeek.io (the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the Service.
2. The Service
Filepeek lets you open, view and convert files in your web browser. Files are processed on your own device and are not uploaded to us. The Service is free and requires no account. We may change, add or remove features at any time.
3. Acceptable use
You agree to use the Service only for lawful purposes and in line with these Terms. You agree not to:
- Open, send or link to files you do not have the right to use, or use the Service to infringe anyone's intellectual property, privacy or other rights
- Use the Service or filepeek.io links to spread malware, phishing, scams or other deceptive or harmful content
- Attack, overload or disrupt the Service, send automated requests in bulk, or try to get around its security or limits
- Copy, resell, rebrand or imitate the Service, or present it as your own
4. Suspension and termination
We may limit, suspend or block your access to the Service, in whole or in part, at any time and without notice, if we believe you have broken these Terms, abused the Service, or put the Service, us or others at risk. We reserve the right to refuse service to anyone, at our sole discretion, for any reason permitted by law.
5. Your files
You keep all rights to your files. Because files are opened on your device, we do not receive them, and these Terms give us no rights to them. You are solely responsible for the files you open, send or link to, and for how you use anything you view or save with the Service.
If you link to files with filepeek.io/#, as described on Add to Your Website, you are responsible for those files, for having the right to share them and for the servers that host them. Visitors download such files directly from your server.
6. Third-party content and services
Files opened from filepeek.io links, links inside files and other websites are not owned or controlled by us, and we are not responsible for their content, safety or availability. When you use Send, your files are handed to Fileport at fileport.io, where their use is governed by Fileport's Terms of Service.
7. Intellectual property
The Service, including its name, logo, design and code, is owned by Fileport and protected by intellectual property laws. Parts of the Service are open source software licensed under their own terms, listed in our licenses file, and nothing in these Terms limits your rights under those licenses. Names of apps and file formats belong to their owners, and Filepeek is not affiliated with or endorsed by them.
8. Disclaimer of warranties
We work to open every file correctly, but we cannot guarantee that every file will open, that what you view or save will match the original, or that the Service will be uninterrupted or error-free. Keep your original files. Information the Service shows about a file, such as a signature check, is provided for information only and is not a guarantee that the file is safe.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Fileport disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, title and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Fileport and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits or revenue, arising out of or relating to your use of, or inability to use, the Service.
10. Indemnification
You agree to indemnify and hold harmless Fileport and its officers, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Service, or the files you link to or send through it.
11. Changes to these Terms
We may update these Terms from time to time. Updated Terms take effect when posted here, with a new date at the top, and your continued use of the Service after that means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. If you are a consumer, you keep any protections of your local law that cannot be waived by contract.
13. General
These Terms and our Privacy Policy are the entire agreement between you and Fileport regarding the Service. If any provision is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms, but we may assign ours, for example in connection with a merger or sale of our business.
